THIS BLOG is NOW RETIRED

I began this blog in May 2009 following the death of Marcia Powell at Perryville State Prison in Goodyear, Arizona. It is not intended to prescribe the path that leads to freedom from the prison industrial complex.

Rather, these are just my observations in arguably the most racist, fascist, militaristic state in the nation at a critical time in history for a number of intersecting liberation movements. From Indigenous resistance to genocidal practices, to the fight over laws like SB1070 and the ban on Ethnic Studies, Arizona is at the center of many battles for human rights, and thus the struggle for prison abolition as well - for none are free until all are. I retired the blog in APRIL 2013.

Family unfit for being poor: AZ CPS.

I've been looking a lot these past few weeks at what happens to young women - girls, in some cases - who are prosecuted for murdering their children because they were too immature to care for them, or they were in a battering relationship and didn't protect their child from the actual abuser in time to save them. They are vilified and charged with abuse or homicide when they do seek help (even when it's apparent they weren't the perpetrator), yet imprisoned for murder when they fight back and kill their abusers instead.

These women have gone to prison for very long periods of time when their children are hurt or die, even those who were children themselves - and therefore victims of sexual abuse - when they conceived their child, like Forrest Day. Forrest was prosecuted as an adult at 16 for her 8-month old child's accidental drowning, and recently killed herself doing time for abuse in the AZ women's state prison, Perryville. She was 19 when she died.

Women are disproportionately prosecuted in "failure to protect" cases - even while many of those women are themselves being victimized by the same perpetrator of the child's abuse, and initiate the contact with emergency services to bring them help. Very seldom are fathers ever prosecuted for failing to protect their children from the mother's abuse, though - and how often are men the victims of women in violent relationships? Yes it happens, but not to the same extent.
Anyway, this article below really struck me today because any woman who gets her kids taken away by Child Protective Services - or turned down as a possible placement - is immediately suspect in our society. They sure don't get support from mainstream media like this, which usually defers to the state version of a person's life and character. Never mind the horrific situations in foster care and adoption that the state has helped put those kids into that they do manage to "rescue" from incapable or abusive parents.

Here's a case, though, where a drug-addicted mother lost her parental rights, and her 2 year old child was taken by CPS even though family wanted to take him instead. Their reasoning had nothing to do with the fitness of the grandmother or aunt as caregivers, though - it appears to be simply because they are poor.

What???

Yes, because they are poor. In a state where 20% of all children are going to bed HUNGRY. Not only are all the other poor kids not being taken away from their loved ones, but they're getting hurt even more by the state through cutbacks to subsistence programs and education, and regressive sales taxes on essentials like food. Poverty, you know, is violence, too. Hunger hurts.

I left my own comment at azfamily.com, after this article, suggesting that people email Mesa Representative Cecil Ash, Chair of the House Health and Human Services Committee, to see what he can do from his end to look into this. His contact info is cash@azleg.gov / (602) 926-3160, if anyone else wants to drop him a note too.

Family grieves after child is taken by CPS

PHOENIX -- They are the cases that tug at the heart, children torn away from their families because Child Protective Services (CPS) believes their living conditions to be unfit.

It's the struggle one Arizona family is trying to cope with right now, losing a young family member, and they say it isn't fair.

Devon Cone is 2 years old.

“Devon is very close to all of us, he's very close to his brothers,” said his aunt, Cari Cone. “We are a very close family. We have all these kids. They are all happy, every single one of them is happy.”

Devon's mom is a drug addict who lost custody of all her children. Her three older boys were all adopted by their maternal grandma years ago. Then came Devon, who turned 2 last week, but his grandma, Mary Boland, was denied Devon.

“I have not slept for days, I have not slept for days,” Boland said.

Cone said she would take him but being unemployed she said CPS denied her, too.

“They told me the reason why is that I don't have the money to take care of him so I said are you going to take my kids too because I don't have the money, but the CPS worker said no,” she said.

That's when Devon went to live with his uncle more than a year ago.

“That's who he thinks is his daddy,” Cone said.

And that's who would be his adoptive daddy, but CPS won't allow it and no one is sure why.

“They are using the excuse that Tracy, my father's ex-wife from 20 years ago, is a better fit,”  Cone said. “
But she is in New Jersey.”

CPS will not comment on this case specifically but says family reunification is their goal, but it doesn't always work out.

“We want to look at a child as an individual. A child may not be a fit with the family. There may be someone else who's a better fit for the child,” said Deidre Calcoate, an adoption manager with CPS. “We would talk to the family and help them understand why the child was not placed with them.”

Whatever the reason, it is impossible for all these broken hearts to understand.

“I want my brother, I want my brother to stay with us,” cried one of Devon's brothers.

Of course, custody battles are always heartbreaking and costly. Still this family plans to fight and hopes to bring Devon home someday.

Cari Cone

This is my newphew he is and will always be loved by this entire family. He has been in our lives for 2 years and have made everyone of us smile. He is VERY LOVED and there is nothing wrong with our family other than showing the love we all have for each other. My Mom has rasied 3 of her own children and now is raising 3 of her grandchildren that all have been loved since the day they were born. My mom has been raising my oldest newphew since he was a year old and has had all 3 of the boys pretty much since birth. Devon lived with his Mom for a very short time as a small infant and was with my mom from about 5 months till he was 13 months and my brother has had him since. This is a VERY LOVED BABY and we will fight CPS and the AZ COURTS till we get Devon back. My sister lost her rights.... The rest of the family will FIGHT to have the RIGHTS WE DESERVE! Thank you to all that are here for us and praying for our family.....

Bad Phoenix Cop assaults teen girl.

ASU NEEB Hall
May 5, 2011

Yes, another cop from Phoenix. Makes you wonder why none of these guys ever get investigated or suspended until their videos go public...at least they nailed this one.

We were
all violated when this cop did this...what the girl was being taken into custody for (or walking away peacefully from) is irrelevant - he could have killed her. If a parent did that for ANY reason, they'd be in lock-up and the girl would be in Child Protective Services' custody.

Good for the Phoenix employee who found the footage and turned it in. I hope that girl's family has a good civil attorney; that seems to be the only thing that gets police departments to take notice and stop tolerating this kind of abuse.

Phoenix police officer on leave after excessive force video found online

PHOENIX - Phoenix police are investigating an officer's actions after a video was found on You Tube of him using excessive force during an arrest.

The incident occurred in January, but was just recently discovered by a police employee who in turn notified a supervisor.

The video shows a Phoenix officer delivering what police refer to as an impact push to a female who is in the process of walking away from an altercation with a parent in a school parking lot.

Police identified the officer as Patrick Larrison, a six-and-a-half-year veteran of the department who is assigned to the Central City Precinct.

Leading up to the incident, Police say the 15-year-old girl involved was drinking and passing out alcohol in school. They say she first fought with a teacher, and then with her mother, before police arrived.

During an afternoon press conference, police spokesman Sgt. Trent Crump called the video a "great concern" to the department. They say the officer's actions went beyond the boundaries of what is considered "reasonable" use of force.

"Obviously we don't like the video out there, and don't want this to be the image of us within the community," Crump said.

The department has initiated a criminal and internal investigation into the officer's actions. Larrison has been placed on administrative leave effective immediately.

The juvenile division of the County Attorney's Office has also been notified.

Another Death at Eyman: Carey Wheatley, 49.

I don't know what exactly this man was accused of, or what he actually did, for that matter. I do know of men and women alike who I believe were wrongfully convicted, however, so before you jump on my blog to post "good riddance", bear in mind that we do have innocent people in prison, including those doing life for murder and facing death for horrendous crimes against children.

That's not to say this guy was innocent - just keep it to yourself if you're doing nothing but trolling for the misery of others to exploit. His survivors, if he has any, will read these posts for a long time to come. So will the survivors of other dead prisoners. Respect them, at least, and lay off.

Furthermore, believe it or not, even some of the guilty ones have a conscience they can't live with. Some men mutilate and destroy themselves so as not to hurt others again with their own buried trauma and rage. Most offenders don't get life or death, though, and are eventually returned to the community - so we need to learn better responses to them than just slamming our collective door, or they're set up to re-offend in the shadows again.

The best way to hold perpetrators accountable and transform their behavior, in this context, is to keep them in the light of higher expectations as community members with major amends to make to us all, not simply to expect the worst when they return from exile. Really, if there was an option of a deserted island where they could go be self-sufficient and not hurt anyone, most of these guys would go - we just don't have that for them, except in prison...some guys even violate themselves and go right back in when released on lifetime probation.

The introduction to prison comes only AFTER these folks violate another human being, though - we need to give them a safe retreat before they go that far. Many many of them display some form of intellectual or psychiatric disability, are still considered victims themselves, and are just beginning to struggle with the manifestations of trauma then. Regardless of how we feel about pedophiles (I'm as disturbed by their conduct as anyone else - especially being a survivor myself), an intervention at that point in the continuum of the criminalization of abuse victims could save lives and prevent another child from being hurt.

Evidence-based practice compels us to begin to look differently - at the level of community - at how we deal with sex offenders coming home from prison. If we let them suffer even more trauma in there and alienation out here, we won't have very much success with them once they're free again to do as they please. Kudos to Barbara Broderick, Chief of Maricopa County Probation Department, for having the wisdom and courage to tackle issue that head-on in last week's panel discussion at the ASU Art Museum (sorry, I didn't report on that one - there are many things I do that I just don't get to) - as she said, even these people are human. I can certainly attest that their stories are often far more complex than headlines let on...

So are their victims', of course. Some of the stories of violent crime victims I profile as well - at least those who are raped, assaulted and murdered in prison or jail. The mainstream victims' rights people take care of the rest.

This notice was released the day the ACLU hit Eyman, by the way, so hopefully they're already getting records.

Our condolences to anyone who cared about this man.

Hey Pearce: SB1097 is Child Abuse.

This is absolutely criminal, what Russ Pearce has been doing to this state. THIS is child abuse. We need a massive direct action/counter-demonstration at the Capitol to stop this corrupt business from proceeding one of these days. How can people NOT stop everything they're doing and look at these men for the frauds they are? They might as well be running around in pink boxers, given what they're trying to sell us.

The women who vote party lines have no excuse for going along. We expect them to be smarter and tougher than the men, actually. Brutal takes neither brains nor perseverance - just willingness to use violence or the threat of it.

The legislation that's come out of the Capitol in Phoenix this past year is nothing less than racist, classist, and brutal - no one is hurting from these budget cuts but those whose voices are diminished by your politics to begin with...those are the voices of The People. You politicians are making out just fine, as far as we can tell - at our expense.

Go tax yourselves, AZ LEGS. Pearce is going to take you right off a cliff if you don't listen to the people you keep hurting. You can't lock us all up at once. Not yet, anyway.

BORDER ACTION NETWORK:

URGENT STATE LEGISLATIVE ALERT!

It's another Russell Pearce effort that will drive the future of Arizona into the ground but this time targeting school children. If this bill sounds familiar, a House version was heard last week.

Tomorrow, Monday, March 29th, the Senate Committee of the Whole will vote on SB1097 -- a bill that threatens to cut state funding from schools unless they report on children's immigration status.

SB1097 Schools; Data; Noncitizen Students
Sponsor: Senator Russell Pearce (R- 18)

This bill seeks to undermine a 1982 Supreme Court decision, Plyer v. Doe that clearly stated that the 14th amendment of the U.S. Constitution protects the rights of all children, regardless of their immigration status in the U.S., to K-12 education. HB2382 threatens to revoke state funding to schools if they do not report on the immigration status of the children at their schools. While the bill falls short of actually denying children access to education, the impact of the intimidation and threat to parents would result in children not being enrolled.

SB1097 ESCUELAS, INFORMACION, ESTUDIANTES NO CIODADANOS

Please take 30 seconds to tell YOUR SENATOR to keep schools focused on education, not on legislators' hate-filled agendas targeting children!
